Motorcycle accidents are often caused by negligent car drivers

In New Hampshire, there are many motorcycle enthusiasts who use the more rural roads for enjoyment of their recreational preference.  At the same time, they face a relatively high risk of being involved in motorcycle accidents. This is not because cyclists are negligent or reckless, but because car and truck operators sometimes have difficulty in seeing motorcycles on the roadway. Many motorcycle accidents are therefore not the fault of the cyclist.

A recent accident in Manchester may illustrate the difficulty that other vehicles have in seeing motorcycle operators in time to avert an accident. Police report that a 30-year-old motorcycle operator is hospitalized with life-threatening injuries from a collision involving an SUV on Candia Road in the evening of July 9. The SUV operator pulled out of a business driveway to cross the westbound lane of Candia Road to travel in the eastbound lane of the roadway.

Officers report that the westbound motorcycle hit the SUV. At first blush, the fact that the report says that the motorcycle crashed into the SUV seems to indicate careless driving by the cyclist. Contrary to that inaccurate wording, the cyclist appears to have had the right of way on Candia Road when the 70-year-old female apparently intruded into his path. When a vehicle come out of a side road or a business premises or private driveway onto a main thoroughfare, the operator must use due caution to not interfere with vehicles traveling on the main roadway.

In most such circumstances, the operator with the right of way, traveling on the main road, will not be deemed at fault in causing the accident. It appears that those basic New Hampshire rules of the road apply in this case. Consequently, the seriously injured cyclist will likely have a viable claim for damages against the SUV operator.
