Drunk driving results in injuries, death of New Hampshire man

A recent fatal car accident in New Hampshire injured several people and claimed the life of a man. Hanover police believe the crash was a result of drunk driving. The driver of the vehicle flipped his pickup on Wolfeboro Road in Hanover on the evening of Friday, Nov. 2.

One of the passengers, a 25-year-old male, was declared dead at the scene. Another of the vehicle's occupants, a woman, was treated and released at the scene. A second woman was taken to an area hospital with serious injuries. The driver of the pickup has been charged with aggravated driving while under the influence and with negligent homicide.

New Hampshire authorities say it's likely that alcohol and the driver's speed were both factors in the accident. Because of this, the female passenger who suffered serious injuries may have grounds for a personal injury claim against the driver of the vehicle. The legal term "duty of due care" indicates that a driver is responsible for taking reasonable precautions to ensure the safety of his passengers, and in this case, it appears he did not follow through.

As the suspect was charged with negligent homicide, the family of the passenger who was killed may also be able to file a wrongful death suit against the driver, since his alleged drunk driving resulted in the death of their loved one. An attorney with experience in personal injury and wrongful death claims caused by drunk driving would be able to advise victims of the accident and surviving family members of their legal rights in this or similar cases. Monetary damages awarded in a successfully presented case could, in this instance for example, be used toward the injured woman's medical expenses, the funeral costs of the deceased or to help compensate for his family's pain and grief.
