Crossover car accidents often strike down innocent victims

It is frightening to see innocent operators struck down by a crossover vehicle that has gone out of control. The fact that one's life can be snuffed out so suddenly and without notice in such car accidents by someone's wrongful driving is a tough reality to accept. In the typical crossover in New Hampshire and elsewhere, one vehicle seemingly goes postal and crosses the median as if looking for prey to strike down.

In most cases, it collides head-on with an innocent operator coming in the opposite direction. The occurrence of car accidents that snuff out innocent, unsuspecting lives are as devastating to see in New Hampshire as anywhere else. These are crushing accidents that are shocking in their ability to inflict such a wide path of human destruction and tragedy.   

It happened on Sept. 13 at about 4 p.m. near the Deer Camp Camping Area. According to police in Ossipee, a Dodge pickup truck going north on Route 16 crossed the centerline and collided head-on with a sedan travelling in the southbound lane. The 61-year-old operator of the sedan died at the scene.

Her 67-year-old passenger was hospitalized with life-threatening injuries. The cause of the driver's lapse of control was undetermined pending further investigation. Police indicated that there is a possibility of criminal charges after the investigation is complete.

Residents of New Hampshire and elsewhere become habituated to car accidents that take such a frightful toll on the victims and their surviving families. Here, the family of the 61-year-old deceased operator has a right to bring a wrongful death action against the pickup driver. The seriously injured passenger also has a right to pursue a personal injury claim against the driver. If the driver was under the influence, that may indicate the possibility of punitive damages against him. If the driver's insurance does not cover all damages, each claimant must look for underinsured motorists' coverage through their own policies.
