3 things you must know about drug charges

If you've been arrested on drug charges in New Hampshire, there are a few things you must know as the case goes forward, before you get to court. It's very important to understand all elements of the law so that you can take the proper steps when considering all of your legal options.

First and foremost, in order to be found guilty, the prosecution has to be able to show that you knew that you had the drugs in the first place. There are cases where people have been arrested without any idea that they were breaking the law. For example, this could happen if someone else put something in your car without telling you.

On top of that, they have to show that you knew the drug has actually been classified as a controlled substance. They cannot assume that you knew if you were actually oblivious. Again, this could go back to someone giving you something and lying about it or not telling you what it was.

Finally, it's important to remember that the things that are used along with the drugs, commonly known as paraphernalia, could bring about possession charges just like the drugs themselves. This could mean that it is a risk to have things like syringes that are used to inject heroin, even if you do not have any heroin yourself. The reason these fall under the same laws is that they can indicate past usage or an intent to use in the future.

It's true that drug laws differ a bit on a state-to-state basis, but you'll find that these three key points are important everywhere.
