Nashua man to plead guilty to child pornography charges

A 42-year-old Nashua man has filed paperwork indicating he will plead guilty to nearly 60 charges involving possession of child pornography and possession of a controlled drug, according to a newspaper report.

The man will enter the guilty plea in exchange for a prison sentence of from 10 years to 25 years in a New Hampshire state prison.

He's to enter the pleas at Hillsborough County Superior Court.

According to court documents, prosecutors have agreed to a 10- to 25-year sentence to charges of possessing child pornography, and seven-year sentences each for possession of a controlled drug and for an apparent failure to register as a sex offender. The seven-year sentences would run concurrently with the longer sentence.

According to the newspaper, the deal would allow the defendant to leave prison after seven years, if he completes a sexual offender treatment program successfully while behind bars, among other conditions.

He was arrested early this year. At the time, police said they found child porn images on his cell phone.

In late summer, prosecutors added 38 counts to the charges against him.

While free on bail, the defendant was arrested in September in possession of a small amount of a substance later determined to be crack cocaine.

The man had apparently argued that prosecutors could not prove that the images on the phone were not computer-created graphics rather than images of actual children; nor could they prove that the images were not of adults who resemble children in appearance.

Prosecutors had countered that experts from the National Center for Missing and Exploited Children had examined the images and determined that the images were child pornography.

A judge has yet to approve the plea agreement between the defendant and prosecutors.

As we can see, punishment for possession of child pornography can be long, making the choice of criminal defense attorney a critical one.
